Summary note

Summarizes Washington State and Colorado laws that legalize, regulate, and tax use of marijuana for recreational purposes. Evaluates extent to which these laws may be preempted by the Controlled Substances Act or by international agreements and treaties that the U.S. is signatory to that prohibit marijuana use for non-medical and non-research purposes. Highlights potential responses to these recent legalization initiatives by Department of Justice, and identifies other noncriminal consequences that marijuana users may face under Federal law. Describes legislative proposals introduced in the 113th Congress relating to treatment of marijuana under Federal law.
