Summary note
Action to annul an act of sale of two slaves, valued at 2000 dollars, fraudulently obtained by St Denis from Cecile, who was intoxicated at the time. Defendant also accused of executing a will, bequeathing said slaves to him, and also a lease, which was written by one Jose del Hoste and witnessed by two Italians. Defendant denied existence of these documents. A supplemenary petition was filed, in which the plaintiff required the defendant to answer certain interrogatories. The defendant ordered that the court strike out the eighth and ninth of these interrogatories, on the ground that there was no allegation in the petition of the existence of a counter letter. There was a judgment for the defendant and the plaintiff appealed. The case was remanded for a new trial. The defendant was required to answer the interrogatories and the appellee pay the costs of the appeal.
